These Terms of Service (“Terms”) govern your use of the website operated by Thompson’s Comfort Connection (“Thompson’s,” “we,” “us,” or “our”), including thompsonscomfortconnection.com, and your use of website forms, appointment requests, estimate requests, and other online features.
These Terms govern use of the website and related online services. HVAC repair, replacement, installation, maintenance, and other services performed at a customer’s property may be governed by a separate proposal, work order, service agreement, financing agreement, warranty, or other written contract.
By accessing or using our website, you agree to these Terms.
1. Website Information
Our website provides general information concerning heating, cooling, HVAC installation, HVAC repair, maintenance, indoor air quality, financing, promotions, and related services.
We make reasonable efforts to provide accurate information. However, product specifications, equipment availability, pricing, promotions, financing programs, rebates, tax incentives, appointment availability, and other information may change.
Information appearing on this website does not constitute a guarantee, professional diagnosis, or binding offer unless we expressly state otherwise in writing.
2. Estimates and Website Pricing
Any price, price range, savings amount, monthly payment, promotional price, rebate amount, replacement estimate, installation estimate, or other pricing information appearing on our website or advertising is informational unless expressly incorporated into a written agreement with the customer.
Website pricing does not constitute a binding quote or offer.
Final pricing may depend upon factors including:
• equipment type, size, efficiency, and availability;
• the condition and configuration of existing HVAC equipment;
• ductwork;
• electrical, gas, drainage, ventilation, or structural requirements;
• accessibility;
• installation complexity;
• permits and applicable code requirements;
• additional labor and materials;
• conditions discovered during inspection or performance of the work;
• manufacturer pricing and availability; and
• eligibility for rebates, incentives, promotions, or financing.
When appropriate, Thompson’s will provide final or revised pricing after evaluating the equipment and property.
3. Free Estimates and Second Opinions
References to a “free estimate,” “free second opinion,” or similar offer are subject to the conditions of the applicable promotion and service area.
Unless specifically stated otherwise in writing, an estimate or second opinion does not obligate the customer to purchase services from Thompson’s.
An estimate is based upon information reasonably available at the time it is prepared. Conditions discovered later may require a revised estimate or additional work.
4. Service Contracts Control HVAC Work
Actual HVAC repair, replacement, installation, maintenance, and related work may be governed by a separate written or electronic proposal, work order, service agreement, invoice, warranty, financing agreement, or contract.
The customer should review those documents before authorizing work.
If these website Terms conflict with a written agreement specifically governing HVAC work performed for a customer, the specific written agreement will control with respect to that work, except where prohibited by law.
Submitting a website form, requesting an appointment, or requesting an estimate does not itself obligate Thompson’s to perform work.
5. Authorization of Work
Work will be performed according to the scope authorized by the customer.
The person approving work represents that they are the property owner or otherwise have authority to authorize the requested work.
If conditions are discovered that materially change the scope or cost of the work, Thompson’s may pause the work and seek authorization for additional work or charges.
Thompson’s is not required to perform work outside the authorized scope without appropriate authorization and compensation.
6. Scheduling
Online, telephone, text, or email appointment requests are requests only until confirmed by Thompson’s.
Appointment times and arrival windows are estimates.
Appointments may be delayed, rescheduled, or canceled because of emergencies, previous service calls, weather, traffic, technician availability, equipment or parts availability, unsafe working conditions, or other circumstances reasonably outside our control.
We will make reasonable efforts to communicate significant scheduling changes.
7. Customer Responsibilities
Customers agree to provide accurate information concerning the property, equipment, reported problem, and requested service.
Customers are responsible for providing safe and reasonable access to equipment and work areas.
Customers should disclose known hazardous or unusual conditions, including electrical problems, structural damage, water damage, hazardous materials, aggressive animals, or other circumstances that could affect technician safety or the work.
Thompson’s may suspend or decline work when conditions are reasonably believed to be unsafe.
8. Concealed or Unknown Conditions
HVAC work may reveal conditions that could not reasonably have been identified before work began.
These may include concealed electrical problems, damaged ductwork, code deficiencies, structural issues, drainage problems, improperly installed equipment, inaccessible components, or damage caused by prior contractors or property conditions.
Unless otherwise required by the applicable contract or law, Thompson’s is not responsible for pre-existing defects or conditions it did not cause.
Additional work required to address such conditions may result in additional charges after appropriate customer authorization.
9. Existing Property and Equipment
Thompson’s will exercise reasonable care while performing services.
Normal HVAC work may require access to walls, ceilings, attics, crawlspaces, roofs, landscaping, finished surfaces, utility areas, or other portions of a property.
Responsibility for access, restoration, patching, painting, carpentry, landscaping, or other work outside the agreed HVAC scope will be governed by the applicable service agreement.
Thompson’s is not responsible for failure or deterioration of pre-existing equipment or property components merely because the condition becomes apparent during or after our work, except to the extent caused by Thompson’s and otherwise required by applicable law.
10. Customer-Supplied Equipment
If Thompson’s agrees to install equipment or components supplied by a customer or another third party, Thompson’s does not warrant the quality, compatibility, performance, or manufacturer warranty coverage of those products unless expressly agreed in writing.
Additional labor required because of incompatible, incomplete, damaged, or defective customer-supplied equipment may result in additional charges.
11. Payment
Payment obligations for HVAC services will be stated in the applicable proposal, work order, invoice, financing agreement, or service contract.
Customers agree to pay properly authorized charges according to those terms.
Applicable taxes, permits, materials, equipment, or additional authorized work may result in additional charges.
Nothing in these Terms authorizes Thompson’s to impose a fee or charge prohibited by applicable law.
12. Financing
Financing may be offered through independent third-party lenders or financing providers.
Financing is subject to credit approval and the lender’s terms.
Any monthly payment, interest rate, promotional financing term, or other financing example appearing on the website or in advertising is illustrative unless expressly stated otherwise.
Actual terms may depend on creditworthiness, amount financed, financing program, term, lender requirements, and other factors.
Thompson’s does not guarantee financing approval.
The customer’s financing relationship with a third-party lender is governed by the applicable lender agreement.
13. Rebates, Tax Credits and Incentives
Manufacturer rebates, utility rebates, government incentives, tax credits, and other third-party programs are controlled by the organizations administering those programs.
Programs and eligibility requirements may change.
Unless Thompson’s expressly guarantees an incentive in a written agreement, Thompson’s does not guarantee that a customer will qualify for or receive a particular rebate, tax credit, incentive, or other third-party benefit.
Customers should consult the applicable program administrator or qualified tax professional regarding eligibility for tax incentives.
14. Promotions
Coupons, discounts, promotional offers, advertised specials, and other incentives may be subject to expiration dates, equipment requirements, geographic limitations, availability, or other stated conditions.
Unless expressly stated otherwise, offers may not be combined.
A promotion incorporated into an executed customer agreement will be governed by that agreement.
15. Warranties
Equipment may be covered by warranties issued by the manufacturer.
Manufacturer warranties are governed by the manufacturer’s terms, exclusions, registration requirements, and procedures.
Any workmanship, labor, satisfaction, maintenance, or other warranty offered directly by Thompson’s is governed by the written warranty or customer agreement accompanying that service.
Website statements do not create additional warranties beyond those expressly provided in writing.
Nothing in these Terms limits warranties or other rights that cannot lawfully be excluded.
16. Cancellations and Legally Required Cancellation Rights
Cancellation rights for HVAC work are governed by the applicable agreement and applicable state and federal law.
Certain transactions entered into at a customer’s residence or away from Thompson’s regular place of business may provide the customer with statutory cancellation rights.
Nothing in these Terms is intended to waive, restrict, or eliminate a cancellation or rescission right provided to a customer by applicable law.
Where required, applicable cancellation notices or forms will be provided separately.
17. Emergency Service
Our website, email, social media accounts, and online forms should not be relied upon for emergencies.
If you suspect a gas leak, carbon monoxide emergency, fire, electrical emergency, or immediate threat to life or property, leave the affected area when appropriate and contact 911, the applicable utility company, fire department, or other emergency service.
18. Communications
When you provide a telephone number or email address, you authorize Thompson’s to use the information to respond to your inquiry and communicate regarding requested estimates, appointments, transactions, and services as permitted by law.
Marketing communications will be sent according to applicable law and the consent provided by the recipient.
Consent to receive marketing communications is not a condition of purchasing services.
Where applicable, message and data rates may apply and message frequency may vary.
Recipients may withdraw consent to marketing text messages through reasonable methods, including following the opt-out instructions contained in the message.
Transactional or service-related communications may continue where permitted by law even after a customer opts out of marketing communications.
19. Photos and Information Submitted Through the Website
Customers may have the ability to provide photographs, descriptions of HVAC equipment, property information, addresses, and other information.
By submitting materials, you represent that you have the right to provide them to Thompson’s.
You authorize Thompson’s to use submitted materials as reasonably necessary to evaluate your request, prepare an estimate, schedule or perform services, maintain business records, and communicate with you.
Submission of a photograph does not guarantee that Thompson’s can diagnose an HVAC condition remotely.
20. Privacy
Personal information collected through our website is handled according to our Privacy Policy.
Our website may use cookies, analytics, advertising technologies, tracking technologies, and third-party services to operate the website, measure performance, understand website usage, and conduct advertising as described in our Privacy Policy.
21. Third-Party Websites and Services
Our website may contain links or integrations involving financing providers, manufacturers, scheduling platforms, review services, advertising platforms, mapping services, social networks, or other third parties.
Those services are operated independently and may be governed by their own terms and privacy policies.
Thompson’s does not control and is not responsible for the operation, availability, security, content, or privacy practices of independent third-party services.
22. Intellectual Property
The Thompson’s Comfort Connection name, logos, website design, original photographs, videos, graphics, advertisements, written content, and other intellectual property appearing on the website are owned by Thompson’s or used with permission unless otherwise indicated.
Website content may be viewed for personal, noncommercial purposes.
Protected content may not be copied, reproduced, republished, distributed, sold, or commercially exploited without permission except as allowed by law.
23. Website Disclaimer
THE WEBSITE AND GENERAL INFORMATION AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.
THOMPSON’S DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE AVAILABLE, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
THIS DISCLAIMER DOES NOT ALTER WARRANTIES EXPRESSLY PROVIDED IN A CUSTOMER’S HVAC SERVICE AGREEMENT OR RIGHTS THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.
24. Limitation of Website Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THOMPSON’S WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING SOLELY FROM USE OF OR INABILITY TO USE THE WEBSITE.
THIS PROVISION DOES NOT EXCLUDE OR LIMIT LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.
LIABILITY RELATING TO ACTUAL HVAC SERVICES IS GOVERNED BY THE APPLICABLE SERVICE AGREEMENT, WARRANTY, AND APPLICABLE LAW.
25. No Waiver of Consumer Rights
Nothing contained in these Terms is intended to waive or restrict a consumer right or remedy that cannot legally be waived.
If a provision of these Terms conflicts with a mandatory requirement of applicable law, the applicable law controls.
26. Governing Law
These Terms are governed by the laws of the State of Utah, except where applicable federal law controls.
Any dispute concerning actual HVAC services may also be governed by dispute-resolution or venue provisions contained in the applicable customer agreement.
27. Severability
If any portion of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.
28. No Waiver
A failure by Thompson’s to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or the right to enforce it later.
29. Changes to These Terms
We may modify these Terms periodically.
Changes will be posted on this website with an updated effective date.
Changes will apply prospectively to website use after publication and will not retroactively alter an existing signed service contract unless permitted by that contract and applicable law.
